Voyagers: Unknown is a collection of digital artworks (Non-Fungible-Tokens (also referred to as “NFTs”)) running on the Ethereum network. This website is merely a portal through which participants can purchase digital collectibles. Users are entirely responsible for the safety and management of their own private Ethereum wallets and validating all transactions and contracts generated by this website before approval. Further to that, because the Voyagers: Unknown smart contract runs on the Ethereum network, no transactions can be undone, reversed, or restored.
This website is managed by Voyagers: Unknown (hereby referred to as “Voyagers: Unknown”, “our” and “We”). You accept and agree to the following terms and conditions solely by accessing, using, and/or purchasing something from our website.
This website, as well as all its linked services, are provided "as is" and “as available” without any warranties of any kind. Using this website entails accepting sole responsibility for any Voyager: Unknown digital collectibles transactions.
OWNERSHIP
Each artwork is an NFT on the Ethereum Blockchain. When you purchase an NFT from our collection, you gain ownership of the purchased artwork (hereby referred to as “VOYAGER”). The ownership of the NFT is entirely mediated by the Smart Contract and the Ethereum Network - We can never confiscate, suspend, or somehow modify the ownership of any Voyagers: Unknown NFT.
In exchange for you continuing to comply with these Terms, Voyagers: Unknown grants you a worldwide, royalty-free license to use, copy, and display the acquired artwork, as well as any additions you may develop or use, solely for the following purposes: (1) for your personal, non-commercial use only; (2) As part of a marketplace that allows the purchase and sale of your VOYAGER / NFT, as long as the marketplace cryptographically verifies each VOYAGER owner's rights to display the artwork for their VOYAGER to ensure that only the rightful owner can display the artwork; (3) As part of a third-party website or application that allows your VOYAGER to be included, involved, or participated in, as long as the website/application cryptographically verifies each VOYAGER owner's rights to display the artwork for their VOYAGER to ensure that only the rightful owner can display the artwork, and provided that the artwork is no longer visible once the owner of the VOYAGER chooses to leave the website/application.
Voyagers: Unknown authorize you the right to use, copy, display, and create derivative works based on the acquired artwork (referred to as "Commercial Use" provided that you continue to comply with these Terms. Examples of such commercial use include the use of the artwork to create and sell commercial products that exhibit copies of the artwork. Examples of such products could be stickers, t-shirts or any other type of merchandise. To be clear, nothing in this paragraph will be construed as preventing you from: (1) Having ownership or operation of a marketplace that permits VOYAGER to be used and sold, as long as it has cryptographically verified each VOYAGER owner's right to display their artwork and ensures that only the rightful owner can display its artwork; (2) Owning or operating a third party website or application that allows the inclusion, involvement, or participation of VOYAGER generally, provided that the third party website or application cryptographically verifies each VOYAGER owner's rights to display the artwork for their VOYAGER to ensure that only the actual owner can display the artwork, and provided that the artwork is no longer visible once the owner of the purchased VOYAGER leaves the website/application; (3) Earning money from any of the aforementioned sources.
Please note that the License granted above does not apply to artwork accompanied by pictures depicting acts of hatred, violence, or any other inappropriate behavior. The License granted above applies only if you own the relevant NFT. By donating, trading or otherwise disposing of your NFT you are giving up any rights to the artwork. This means that if at any time in the future for whatever reason - the license granted above will expire without notice and give no further right with respect to this particular digital asset!
However, aside from the rights to the artwork, nothing in this Agreement grants you any rights to any other trademarks or intellectual property rights owned by Voyagers: Unknown, including, but not limited to, Voyagers: Unknown, VOYAGER, and the associated logos. All of these rights are expressly reserved by Voyagers: Unknown.
Feedback, such as comments, bug reports, ideas, or suggestions, may be submitted, including feedback on ways to improve the Site (hence, "Feedback" Feedback that you submit is your permission to us to use it in any way we deem appropriate without compensating you in any way, and you grant us a perpetual, irrevocable, nonexclusive, worldwide license to incorporate and use the feedback for any purpose.
FEES AND PAYMENT
The website will only handle financial transactions that are conducted through the Ethereum network if you choose to purchase a VOYAGER through it. Payments and transactions will be out of our control and we won't be able to reverse them. If you engage in any transactions or conduct any other transactions via the Ethereum network, we will not be liable for any claims or damages arising from such transactions.
Transactions on Ethereum are subject to a fee (also referred to as “Gas Fee”) that is charged at the beginning of the transaction cycle. Using the Gas Fee, the decentralized Ethereum network can maintain its network of computers. Therefore, all transactions will be subject to a fee. The Gas Fee does not go to us nor do we have control over its pricing.
YOUR OBLIGATIONS
You are solely responsible for your own actions while accessing or using the Site, as well as any repercussions thereof. You agree to use the Website only for legitimate, appropriate, and in compliance with the Terms and any relevant laws or regulations. As an example and without any limitation, you may not, and may not allow any third party to: (1) Publish, send, or otherwise modify any illegal, defamatory, harassing, abusive, violent, hateful, obscene, fraudulent or otherwise inappropriate material; (2) Upload any destructive or deceptive software, including viruses, worms, flaws, Trojan horses, corrupted files, or hoaxes. (3) Falsely claim to be another person. (4) Participate in any activities that infringe upon the intellectual property rights of another party or otherwise violate their legal rights shall not be undertaken on the website. (5) Take part in, promote, or encourage illegal activities (including, but not limited to, money laundering); (6) Engage in behavior that interferes with other users' usage of the website. (7) Engage in any unauthorized commercial activity on the website. (8) Reverse engineer, modify, adapt, or adapt any portion of the website. (9) Take down any provisions that mention copyright, trademark or other proprietary rights within or on the website or any part of it. (10)For any unauthorized purpose, collect information about the website with any technology. (11) Attempt to access or use the Site in order to come up with products or services that are competitive with ours. As you consider selling your VOYAGER NFT, please be aware that the price of NFTs is highly volatile and changes in the price of other NFTs have the potential to negatively or positively affect the price of your VOYAGER. In view of the volatility associated with NFTs, they should not be considered investments. In that regard, you assume all risks.
Furthermore, ownership of a VOYAGER grants the right to own digital artwork only, and no information on this website (the documents therein, as well as any others) is or should be construed as investment advice. In addition, nothing on this website constitutes or qualifies as an offer or invitation to buy stock or securities in any jurisdiction. Irrespective of legislation in any jurisdiction, nothing on this website constitutes an offer to sell or buy shares, securities or other financial products. Voyagers: Unknown has not been registered or regulated in any jurisdiction given the artistic nature of the project. To ensure that your purchase of Voyagers: Unknown and any related artwork is compliant with the laws and regulations of your jurisdiction, it remains your sole responsibility.
With Internet-based currencies, all associated risks apply, including, but not limited to, risks associated with hardware, software and Internet connections, the introduction of malicious software, as well as the possibility that third parties could gain unauthorized access to your wallet.
Despite NFTs, cryptocurrencies, and blockchains being relatively new, the regulatory landscape is still fairly unclear. Regulating such technologies negatively could reduce the value of your Voyager. Therefore, you acknowledge and accept all associated risks.
The Ethereum platform, or any adverse outcomes it may have due to disruptions or other issues, are solely your responsibility.
